These Terms and Conditions of Sale govern all consumer sales concluded through the BOTASENS online store between DSK GROUP, operating the BOTASENS brand (“BOTASENS”, “we”, “us” or “our”), and any consumer purchasing products through our website (“Customer”, “you” or “your”).
By placing an order, the Customer confirms that they have read and accepted these Terms and Conditions of Sale.

2. Scope and Acceptance
These Terms and Conditions apply to purchases made by consumers through the BOTASENS online store.
By completing an order, the Customer accepts these Terms and Conditions together with the applicable:

Shipping Policy;

Return & Refund Policy; and

Privacy Policy.
The version applicable to an order is the version in force when the Customer places the order.
3. Pre-Contractual Information
Before placing an order, the Customer is provided with the essential information relating to the products and transaction, including where applicable:

the essential characteristics of the products;

product quantity and size;

price;
-
applicable taxes;
-
available delivery methods;
-
applicable shipping costs;

payment methods;

information regarding returns;

information regarding the statutory right of withdrawal.
The Customer is responsible for reviewing this information before confirming the order.
4. Products
BOTASENS sells concentrated laundry fragrances and other home-care products as presented on the website.
Product pages provide the main characteristics and, where applicable, fragrance information, quantity, recommended dosage, instructions for use and precautions.
Customers must follow the instructions and precautions provided on the product, packaging or website.
Product photographs and visual representations are provided for illustrative purposes. Minor differences in colour, appearance or packaging may occur without affecting the essential characteristics or conformity of the product.
5. Availability
Products are offered subject to availability.
If a product becomes unavailable after an order has been placed, BOTASENS will inform the Customer as soon as reasonably possible.
Depending on the circumstances, BOTASENS may offer:

reimbursement of the unavailable product;

an alternative product with the Customer's agreement; or
-
another appropriate solution agreed with the Customer.
6. Prices
Prices are displayed in the currency applicable to the selected market and include VAT where required by applicable law.
Any applicable shipping costs are displayed before the Customer completes the purchase.
BOTASENS may change product prices at any time. The price applicable to an order is the price displayed and accepted by the Customer at the time the order is confirmed.
In the event of an obvious pricing or technical error, BOTASENS may cancel the affected order. If payment has already been collected, the corresponding amount will be refunded.
Promotions, discount codes, gifts and other commercial offers may be subject to specific conditions, including validity periods, minimum purchase amounts, product restrictions and non-combination rules.
7. Ordering Process
The Customer selects the desired products and adds them to the shopping cart.
Before payment, the Customer has the opportunity to review and, where applicable, correct the contents of the order and the information provided.
The Customer is responsible for ensuring that billing, delivery and contact information is complete and accurate.
After an order has been successfully placed, an electronic order confirmation will be sent to the Customer.
BOTASENS may refuse or cancel an order for legitimate reasons, including:

payment refusal or suspected fraud;

previous unresolved payment disputes;

obvious technical or pricing errors;

product unavailability;
-
abnormal quantities suggesting professional resale rather than consumer use; or

fraudulent or abusive use of promotional offers.
If BOTASENS cancels an order after payment has been collected, the corresponding amount will be refunded.
8. Payment
Payment is due when the order is placed.
Available payment methods are displayed during checkout and may vary according to country, currency or device.
Payments are processed through secure third-party payment providers.
BOTASENS does not directly store complete payment card information.
An order may be suspended or cancelled if payment cannot be authorized or validated or if a transaction is reasonably suspected of being fraudulent.
9. Shipping and Delivery
Available delivery methods, shipping costs and any applicable free-shipping conditions are displayed during the ordering process.
Depending on the destination, delivery options may include:

home delivery;

pick-up point delivery;
-
locker delivery.
The Customer is responsible for providing accurate and complete delivery and contact information.
Delivery times displayed during the ordering process are estimates and may vary depending on the destination, carrier, public holidays, periods of high demand or circumstances outside BOTASENS' reasonable control.
Customers selecting a pick-up point or locker must collect the parcel within the collection period specified by the carrier.
If a parcel is returned to BOTASENS because it was not collected or because the Customer provided incorrect or incomplete delivery information, additional shipping costs may apply if the Customer requests reshipment.

10. Transfer of Risk
For consumer purchases, risk relating to the products transfers to the Customer in accordance with applicable consumer law, generally when the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the goods.
11. Statutory Right of Withdrawal
Where applicable under consumer law, the Customer has a statutory period of 14 days to withdraw from an eligible distance purchase without having to provide a reason.
The withdrawal period generally begins on the day on which the Customer, or a third party designated by the Customer other than the carrier, receives the goods.
To exercise the right of withdrawal, the Customer must notify BOTASENS within the applicable period by means of a clear statement expressing the decision to withdraw.

Where the statutory right of withdrawal applies, products must be returned in accordance with applicable law and the return instructions provided by BOTASENS.
Unless otherwise required by applicable law or agreed by BOTASENS, direct return shipping costs are borne by the Customer.
Where applicable, statutory exceptions to the right of withdrawal may apply, including to sealed goods that are not suitable for return for health protection or hygiene reasons and have been unsealed after delivery.
Nothing in this section limits any mandatory rights available to consumers under applicable law.
12. BOTASENS 30-Day Money-Back Guarantee
In addition to applicable statutory rights, BOTASENS offers a commercial 30-Day Money-Back Guarantee.
The purpose of this guarantee is to allow Customers to discover BOTASENS fragrances with greater confidence.
A Customer may try one bottle from an order and, if they are not satisfied with the fragrance, contact BOTASENS within 30 days of delivery.
The commercial guarantee applies to one opened bottle per order.
If an order contains several products, additional products must remain unopened, unused and in their original packaging to qualify for a return under the commercial guarantee, unless otherwise required by applicable law.
The guarantee is subject to the conditions set out in our Return & Refund Policy.
BOTASENS may refuse claims where there is reasonable evidence of fraud, repeated excessive claims or abuse of the commercial guarantee.
The BOTASENS 30-Day Money-Back Guarantee is in addition to statutory consumer rights and does not replace, restrict or reduce those rights.
13. Returns and Refunds
Customers requesting a return or refund should contact:

Products should not be returned before receiving the appropriate instructions from BOTASENS.
Where a refund is approved, it will normally be made using the original payment method unless otherwise agreed or required by applicable law.

14. Damaged, Defective or Incorrect Products
If a parcel or product arrives damaged, defective or incorrect, the Customer should contact BOTASENS as soon as possible.
We may request:

the order number;

a description of the issue;

photographs of the parcel and/or products; and

other information reasonably necessary to assess the issue.
BOTASENS will provide an appropriate remedy in accordance with applicable consumer law.
15. Statutory Legal Guarantees
Consumers benefit from all statutory legal guarantees applicable to their purchase, including applicable rights relating to product conformity and hidden defects.
These legal guarantees apply independently of the BOTASENS 30-Day Money-Back Guarantee.
Nothing in these Terms excludes, restricts or replaces any mandatory legal guarantee or remedy available to a consumer.

16. Product Use
Customers must use BOTASENS products according to the instructions and precautions provided.
The Customer is responsible for:

using products only for their intended purpose;

following recommended dosage and instructions;

observing safety information; and

storing products appropriately.
BOTASENS cannot be held responsible for damage resulting from improper use, improper storage or failure to follow the instructions, except where liability cannot legally be excluded or limited.
17. Retention of Title
Products remain the property of BOTASENS until full payment of the purchase price has been received.
This provision does not affect the rules governing transfer of risk to consumers under applicable law.
18. Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
BOTASENS remains responsible for fulfilling its legal and contractual obligations toward consumers.
To the extent permitted by law, BOTASENS shall not be liable for losses resulting from improper use of the products, the Customer's own actions or circumstances outside BOTASENS' reasonable control.
19. Force Majeure
BOTASENS shall not be liable for a delay or failure to perform an obligation where performance is prevented by an event qualifying as force majeure under applicable law.
Where such an event occurs, BOTASENS will make reasonable efforts to limit its impact on affected orders and Customers.
20. Personal Data
Personal information collected in connection with orders and customer relationships is processed in accordance with applicable data protection law, including the GDPR where applicable.

21. Intellectual Property
The BOTASENS name, trademarks, logos, photographs, videos, graphics, product descriptions, designs and other website content are protected by applicable intellectual property laws.
Such content belongs to DSK GROUP, BOTASENS or their respective licensors and partners.
Unauthorized reproduction, distribution, modification or commercial use is prohibited except where permitted by applicable law.

We encourage Customers to contact us first so that we can attempt to resolve any dispute amicably.
Where required by applicable French consumer law, eligible Customers may have access to an independent consumer mediation service after first attempting to resolve the matter directly with BOTASENS.
Details of the consumer mediator designated by DSK GROUP will be made available in accordance with applicable legal requirements.
23. Governing Law and Jurisdiction
These Terms and Conditions of Sale are governed by French law.
Where the Customer is a consumer residing in another country, this choice of law does not deprive the Customer of mandatory consumer protections available under the laws applicable in their country of habitual residence.
In the event of a dispute, the parties are encouraged to seek an amicable solution first.
Any court proceedings will be brought before the competent courts determined in accordance with applicable consumer protection and jurisdiction rules.
24. General Provisions
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions will remain in effect.
Failure by BOTASENS to enforce a provision at any particular time does not constitute a waiver of the right to enforce that provision later.
The Terms and Conditions applicable to an order are those accepted by the Customer when the order is placed.
